This paper provides a commentary (Thuyết Minh) on the second iteration of the legal concept “Ngoại Vong Pháp Luật” (Outlawry) within Vietnamese criminal justice. Historically, outlawry referred to the status of an individual who is excluded from the protection of the law, often due to fleeing justice or committing certain heinous crimes. Part 1 of this commentary series examined the colonial-era foundations. This follow-up (“Phần 2”) analyzes the post-Đổi Mới legal reforms, focusing on how the 2015 Criminal Procedure Code and subsequent amendments have redefined or effectively abolished the formal concept of outlawry, while allowing functional equivalents (e.g., asset forfeiture in absentia, international arrest warrants).
